Back in August, President Donald Trump had confirmed that his administration is “looking at” a proposal to move cannabis from Schedule I to Schedule III of the federal Controlled Substances Act (CSA), with a decision expected “over the next few weeks.”
This was the first time the president had spoken publicly about cannabis rescheduling since taking office. His remarks follow reports from CNN and The Wall Street Journal that the White House is actively reviewing agency recommendations on the matter, which is a development with significant implications for the cannabis industry and federal marijuana policy change in 2025.
The potential rescheduling of cannabis is at the top of NDASA's advocacy and educational efforts. If rescheduling or descheduling occurs, the change must include a common-sense safety-sensitive carve-out. Upon any change from a Schedule I or II substance, marijuana will no longer be permissible for testing under federal/Department of Transportation (DOT) Regulations. This change will leave a very obvious, dangerous, and impactful gap in safety. Can you imagine a world where truck drivers, bus drivers, airline pilots/mechanics, train operators, and ship captains are not tested for marijuana, the most common drug that tests positive in our industry? We are not too far from that reality if a safety-sensitive carve-out is not included with any planned change.
The Drug Screening Compliance Institute's Senior Research Attorney, William J. Judge, JD. LL.M., will join a roundtable of industry experts and federal policymakers to discuss the impacts that marijuana rescheduling will have on workplace substance abuse screening programs. This discussion is hosted by the National Drug & Alcohol Screening Association (NDASA).
